RESOLUTION NO. 2019 – 09
A RESOLUTION TO TRANSFER BALANCE OF ALL FUNDS
FROM THE UTILITY DEPOSIT REFUND FUND TO THE
GENERAL FUND AND DECLARING AN EMERGENCY
WHEREAS, over the past 30 years, the Utility Department has accepted deposits from customers to open up individual utility accounts; and
WHEREAS, this practice has now stopped; and
WHEREAS, there is currently an excess of utility deposits in the Utility Deposit Refund Fund; and
WHEREAS, the Utility Department has made a diligent effort to return the excess utility deposits to the rightful owners; and
WHEREAS, there still exists the sum of $37,550.86 of unclaimed deposits in the Utility Deposit Refund Fund; and
WHEREAS, no good reason exists to continue to hold those funds and the account needs to be dissolved; and
WHEREAS, no injury will occur to any known customer or entity.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ST. CLAIRSVILLE, OHIO, AS FOLLOWS:
Section 1: That pursuant to Ohio Rev. Code §5705.16, the funds currently on deposit in the Utility Deposit Refund Fund are hereby ordered to be transferred to the General Fund by the City’s Fiscal Officer.
Section 2: That this Resolution is declared to be an emergency measure necessary for the immediate preservation of the public peace, health and the safety of the residents of the City of St. Clairsville so that the City can maintain normal operations.
Section 3: That this Resolution shall take effect and be in force from and after the earliest period allowed by the Charter of the City of St. Clairsville, Ohio.
