ORDINANCE AUTHORIZING THE MAYOR AND

SERVICE DIRECTOR TO ENTER INTO A TEMPORARY EASEMENT

AND RIGHT-OF-WAY AGREEMENT WITH THE

CITY OF ST. CLAIRSVILLE, OHIO AND GULFPORT ENERGY CORPORATION AND DECLARING AN EMERGENCY

WHEREAS, the City of St. Clairsville, Ohio, finds it to be in the best interest of the City to enter into a Temporary Easement and Right-of-Way Agreement with Gulfport Energy Corporation.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ST. CLAIRSVILLE, OHIO:

Section 1: That the Mayor and Service Direct are hereby authorized to sign the Temporary Easement and Right-of-Way Agreement with Gulfport Energy Corporation for temporary water transportation lines and water access lines identified in the attached Exhibit A.

Section 2: That this Ordinance is declared to be an emergency measure necessary for the immediate preservation of the public peace, health, welfare and safety of the residents of the City of St. Clairsville in order to enter into an agreement for temporary water transportation lines and water access lines.

Section 3: This Ordinance shall take effect and be in force from and after the earliest period allowed by law.

PASSED at a regular meeting of the Council of the City of St. Clairsville on this 19th day of June, 2017, by the affirmative vote of 7 members of the Council.
