ORDINANCE NUMBER 2019 – 05

AN ORDINANCE AUTHORIZING A REQUEST TO THE BOARD

OF BUILDING STANDARDS TO CERTIFY THE CITY OF ST. CLAIRSVILLE

TO EXERCISE ENFORCEMENT AUTHORITY IN ACCORDANCE WITH

THE OHIO BASIC BUILDING CODE WITH THE CONDITION THAT THE

MUSKINGUM COUNTY BUILDING DEPARTMENT PERFORM ALL

INSPECTIONS AND AUTHORIZING AN AGREEMENT FOR SUCH

ENFORCEMENT BETWEEN THE CITY OF ST. CLAIRSVILLE

AND MUSKINGUM COUNTY, OHIO, AND DECLARING AN EMERGENCY

WHEREAS, the Board of Building Standards of the State of Ohio has formulated and adopted the Ohio Basic Building Code containing regulations governing the erection, construction, repair, alteration and maintenance of all building or classes of building specified in Section 3781.06 of the Ohio Revised Code; and

WHEREAS, the said Board of Building Standards has certified the Muskingum County Building Department to exercise enforcement authority in accordance with the Ohio Basic Building Code; and

WHEREAS, it is necessary in accordance with law to administer and enforce the Ohio Basic Building Code within the limits of the City of St. Clairsville pursuant to Section 3781.10(E) of the Ohio Revised Code; and

WHEREAS, it is necessary for the City of St. Clairsville to request the Ohio Board of Building Standards to certify the City of St. Clairsville to enforce the Ohio Basic Building Code with the condition that the Muskingum County Building Department performs all inspections and exercise enforcement authority in accordance with the Ohio Basic Building Code; and

WHEREAS, it is necessary that an agreement be entered into between the City of St. Clairsville and Muskingum County for the enforcement of the Ohio Basic Building Code and to perform all inspections and exercise enforcement authority in accordance with the Ohio Basic Building Code within the limits of the City of St. Clairsville.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ST. CLAIRSVILLE, OHIO:

Section 1:        The Mayor of the City of St. Clairsville is hereby authorized and directed to sign and submit an application to the Board of Building Standards requesting said board to certify the City of St. Clairsville Building Department to enforce the Ohio Basic Building Code with the condition that Muskingum County Building Department perform all inspections and exercise enforcement authority as necessary in accordance with the Ohio Basic Building Code within the limits of said City and to enter into an agreement with Muskingum County for such purpose.

Section 2:        The City of St. Clairsville, through its Mayor and Service Director, is hereby authorized and directed to enter into an agreement with Muskingum County for the enforcement of the Ohio Basic Building Code within the limits of the City of St. Clairsville, whereby the Muskingum County Building Department will exercise all enforcement authority and accept and approve plans and specifications and make inspections necessary within the City of St. Clairsville in accordance with the provisions of the Ohio Administrative Code 4101:1 – Board of Building Standards:  the Ohio Building Code; and 4101:2 – Board of Building Standards:  the Ohio Mechanical Code.

Section 3:        That this Ordinance is declared to be an emergency measure necessary for the preservation of the public peace, health, safety, and economic well being of the City of St. Clairsville in order that the City of St. Clairsville be authorized to exercise enforcement authority in accordance with the Ohio Basic Building Code with the condition that the Muskingum County Building Department perform all inspections.

Section 4:        That this ordinance shall take effect and be in full force from and after the earliest period allowed by the Charter of the City of St. Clairsville, Ohio.
