ORDINANCE NUMBER 2020-26

AN ORDINANCE PROHIBITING THE FEEDING

OF WILDLIFE WITHIN THE CITY OF ST.CLAIRSVILLE

WHEREAS, Council has determined that there is a need to establish an ordinance prohibiting the feeding of wildlife that creates a nuisance endangering the health, safety, and welfare of the public within the city limits of the City of St. Clairsville.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ST. CLAIRSVILLE, OHIO:

Section 1:       That Title V, General Offenses Code, Chapter 505, Animals and Fowl, shall be amended by adding Section 505.16, Feeding of wildlife prohibited

505.16  FEEDING OF WILDLIFE PROHIBITED.

(a)  No person shall intentionally provide food for deer, geese, ducks, raccoons, rodents, fowl or other wild animals or wild life by setting such food out on any public or private property thereby creating a nuisance that endangers the health, safety, and welfare of the public.  This section does not apply to animals owned by a person or song birds fed from a sanitary bird feeder so long as doing so does not create a nuisance.

(b)  Whoever violates any of the provisions of this section is guilty of a minor misdemeanor.  Penalty shall be as provided in Section 501.99.

Section 2:       All ordinances inconsistent herewith are repealed to the extent of the inconsistencies.

Section 3:       This Ordinance shall take effect and be in force from and after the earliest period allowed by the Charter of the City of St. Clairsville.
