RESOLUTION NUMBER 2021-4
A RESOLUTION APPROVING THE SOLID WASTE MANAGEMENT PLAN OF THE
JEFFERSON BELMONT REGIONAL SOLID WASTE AUTHORITY AND
DECLARING AN EMERGENCY
WHEREAS, the Jefferson Belmont Regional Solid Waste Authority, by its Board of Trustees, has adopted a Solid Waste Management Plan for the Authority; and
WHEREAS, pursuant to Ohio Revised Code Section 3734.55(B), the Board of County Commissioners and the legislative authority of each municipal corporation or township under the jurisdiction of the Authority, must approve or disapprove the Plan by ordinance or resolution; and
WHEREAS, the City of St. Clairsville, Belmont County, Ohio have reviewed the Plan and considered it at a duly called meeting; and
WHEREAS, the Plan furthers the public interest; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ST. CLAIRSVILLE, OHIO:
SECTION 1: That the Council for the City of St. Clairsville hereby approves of the Solid Waste Management Plan of the Jefferson Belmont Regional Solid Waste Authority, adopted by the Board of Trustees on December 14, 2020.
SECTION 2: That the Clerk is hereby directed to promptly deliver, or cause to be delivered, a copy of this Resolution of Approval to the Jefferson Belmont Regional Solid Waste Authority, 228 Technology Way, Steubenville, Ohio 43953.
SECTION 3: That it is found and determined that all formal actions of this City Council concerning and relating to the passage of this resolution were adopted in an open meeting of this City Council and any of its committees that resulted in such formal actions were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
SECTION 4: That this Resolution is declared to be an emergency measure necessary for the immediate preservation of the public peace, health, and safety of the residents of St. Clairsville for the reason that solid waste management is a primary concern and the activities of the Jefferson Belmont Regional Solid Waste Authority need to proceed without delay.
SECTION 5: That this Resolution shall take effect and be in force from and after the earliest period allowed by the Charter of the City of St. Clairsville, Ohio.
PASSED at a meeting of the Council of the City of St. Clairsville on this 15th day of March, 2021, by the affirmative vote of 7 members of the council.
