ORDINANCE 2021-11
AMENDING CODIFIED SECTION 337.20 (ORC 4513.22) TO ADD LANGUAGE
REGARDING THE USE OF ENGINE BRAKES (JAKE BRAKES) WITHIN THE
MUNICIPALITY AND DECLARING AN EMERGENCY.
WHEREAS, Council has determined that there is a need to address the use of Engine Brakes (Jake Brakes) within City limits.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ST. CLAIRSVILLE, OHIO:
SECTION 1: That Codified Ordinance Section 337.20(c) is hereby amended to read, as follows:
(c) No person, while operating a motor vehicle within the municipality, shall activate an engine brake, “Jake Brake”, on such motor vehicle unless other parking devices on the vehicle have failed or exigent circumstances which require the use of such a brake system
SECTION 2: That Codified Ordinance Section 337(d) is hereby amended and added to read, as follows:
(d) Whoever violates this section is guilty of a minor misdemeanor.
SECTION 3: That this Ordinance is declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare of the residents of the City of St. Clairsville so that the City can maintain normal operations.
SECTION 4: That this Ordinance shall take effect and be in force from and after the earliest period allowed by the Charter of the City of St. Clairsville, Ohio.
PASSED at a meeting of the Council of the City of St. Clairsville on this 7th day of June, 2021, by the affirmative vote of 6 members of the council.
