ORDINANCE NUMBER 2021-42
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE
CITY OF ST. CLAIRSVILLE TO EXECUTE EASEMENTS AND RIGHTS OF WAY
FROM THE CITY OF ST. CLAIRSVILLE, OHIO, TO THE OHIO POWER COMPANY,
AN OHIO CORPORATION, A UNIT OF AMERICAN ELECTRIC POWER (“AEP”)
FOR THE GLENCOE-ROBYVILLE LINE AND DECLARING AN EMERGENCY
WHEREAS, the City of St. Clairsville is the owner of seven (7) parcels of real property, designated as Parcel Nos. 34-02609.001, 34-02609.002, 34-02359.001, 34-02656.000, 34-60036.000, 34-02660.000 and 34-01125.000, and more fully described in the attached Exhibits A through G; and
WHEREAS, the Ohio Power Company, an Ohio corporation, a unit of American Electric Power (“AEP”) desires a permanent easement and right of way for electric transmission, distribution, and communication lines and appurtenant equipment and fixtures in, on, over, under, through and across said parcels for a line known as the Glencoe-Robyville Line; and
WHEREAS, Council for the City of St. Clairsville approves the granting of said electric transmission, distribution and communication line easements to the Ohio Power Company, an Ohio corporation, a unit of American Electric Power (“AEP”) for the Glencoe-Robyville Line in that it will promote the welfare of the people of the City, stabilize the economy, provide employment and assist in the development of commercial activities to the benefit of the people of the City, and provide additional opportunities for their gainful employment.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ST. CLAIRSVILLE, OHIO:
SECTION 1: That the Mayor of the City of St. Clairsville is directed and authorized to execute said deeds of easement and rights of way as described in attached Exhibits A through G to the Ohio Power Company, an Ohio corporation, a unit of American Electric Power (“AEP”).
SECTION 2: That this Ordinance is declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare of the residents of the City of St. Clairsville.
SECTION 3: That this Ordinance shall take effect and be in force from and after the earliest period allowed by the Charter of the City of St. Clairsville, Ohio.
PASSED at a meeting of the Council of the City of St. Clairsville on this 20th day of December, 2021, by the affirmative vote of 6 members of the council.
