ORDINANCE NUMBER 2022-6

AN ORDINANCE AUTHORIZING THE CITY OF ST. CLAIRSVILLE TO ENTER

INTO CONTRACT FOR THE TEMPORARY I-70 WATERLINE REPAIR AND

PERMANENT PIPING CONNECTION AND DECLARING AN EMERGENCY

WHEREAS, the City of St. Clairsville has an urgent and pressing emergency regarding a leak in one of the two main supply lines to the entire City’s water supply underlying Interstate 70; and

WHEREAS, the Ohio Environmental Protection Agency has requested that the City take immediate action to remedy the water leak by running a temporary line over the bridge on Reservoir Road over passing I-70; and

WHEREAS, the City of St. Clairsville, in connection with the Ohio EPA’s request, has inquired with Border Patrol for quotes for the building of a Temporary Waterline and Permanent Piping Connection and those are deemed acceptable by the City.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF ST. CLAIRSVILLE, STATE OF OHIO:

SECTION 1:  Pursuant to the Charter of the City of St. Clairsville, Article VII, Section 5, due to the real and present emergency arising in connection with the operation and maintenance of the City’s water service, the City hereby approves contracting with Border Patrol for the construction of a temporary waterline and a permanent piping connection.

SECTION 2Jeremy Greenwood, Public Service/Safety Director, shall be authorized to execute any and all necessary documentation on behalf of the City of St. Clairsville as and for the purpose of proceeding with execution of this agreement.

SECTION 3:  That this Ordinance is declared to be an emergency measure, necessary for the immediate preservation of the public health, safety and welfare of the said City. 

SECTION 4That this Ordinance shall take effect and be in force from and after the earliest period allowed by the Charter of the City of St. Clairsville, Ohio.

PASSED at a meeting of the Council of the City of St. Clairsville on this 28th day of February, 2022, by the affirmative vote of 7 members of council.
