ORDINANCE NUMBER 2022-17
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE
CITY OF ST. CLAIRSVILLE TO AUTHORIZE THE EXECUTION OF A HOUSING
REVOLVING LOAN FUND ADMINISTRATION AGREEMENT WITH THE STATE
OF OHIO DEPARTMENT OF DEVELOPMENT AND DECLARING AN EMERGENCY
WHEREAS, the Ohio Department of Development through its Office of Community Development (“OCD”) administers the federal Community Development Block Grant (“CDBG”) Program and the HOME Investment Partnerships (“HOME”) program for the State of Ohio;
WHEREAS, the City of St. Clairsville has been determined to be an eligible recipient of CDBG and/or HOME funds;
WHEREAS, the City of St. Clairsville has been awarded CDBG and/or HOME funds from the Ohio Department of Development to Finance eligible activities that may generate program income as defined herein;
WHEREAS, the Ohio Department of Development has recognized the positive impact on community development initiatives when the use of program income is locally determined;
WHEREAS, the Ohio Department of Development has permitted the establishment of Housing Revolving Loan Funds within the local political subdivisions to meet the primary goals of 1.) improving the affordable housing stock, and 2.) providing for the affordable housing needs of low and moderate-income persons for the Housing Revolving Loan Fund; and
WHEREAS, as a condition for the continued eligibility and participation in the CDBG and HOME funded Ohio Community Housing Improvement Program, the Ohio Department of Development requires the City of St. Clairsville to enter into a Housing Revolving Loan Fund Administration Agreement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ST. CLAIRSVILLE, OHIO:
SECTION 1: That the Mayor is hereby authorized to enter into agreement with the Ohio Department of Development for the local administration of the Housing Revolving Loan Fund as attached hereto as Exhibit “A”.
SECTION 2: That it is hereby represented that all deliberations of this Council and of any part of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
SECTION 3: That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, welfare, and safety of the City of St. Clairsville and its citizens to allow for assistance under the CDBG/HOME Program that is needed to aid in that orderly development of the community.
SECTION 4: This Ordinance shall take effect and be in force from and after the earliest period allowed by the Charter of the City of St. Clairsville, Ohio.
PASSED at a meeting of the Council of the City of St. Clairsville on this 4th day of April, 2022, by the affirmative vote of 7 members of the council.
