AN ORDINANCE AMENDING ORDINANCE NO. 2021-29

AND AUTHORIZING AND DIRECTING THE

DIRECTOR OF PUBLIC SERVICES TO SOLICIT

COMPETITIVE BIDS FOR THE RESURFACING OF

STREETS IN THE CITY OF ST. CLAIRSVILLE

AND AUTHORIZING AN EXPENDITURE

NOT TO EXCEED $250,000.00 FOR THE CALENDAR

YEAR 2021 TO BE COMPLETED IN CALENDAR YEAR 2022

AND DECLARING AN EMERGENCY

WHEREAS, by Ordinance Number 2021-24, Council authorized an expenditure not to exceed $185,000.00 for the resurfacing of streets in the City of St. Clairsville; and

WHEREAS, by Ordinance Number 2021-26, approved by Council on September 20, 2021, the resurfacing bid for the calendar year 2021 was awarded to Cast & Baker; and

WHEREAS, by Ordinance Number 2021-29, Council amended Ordinance 2021-24 and authorized an expenditure not to exceed $200,000.00 for the resurfacing of streets in the City of St. Clairsville; and

WHEREAS, Cast & Baker were unable to start the resurfacing project in the City of St. Clairsville during Calendar Year 2021 due to the lack of availability of supplies and due to the winter shut down of the asphalt plants; and

WHEREAS, on December 8, 2021, the City of St. Clairsville was officially notified by the State of Ohio, that the City was being awarded a Five Million Dollar ($5,000,000.00) grant from the Ohio Environmental Protection Agency to initiate and proceed with the replacement of the City’s water distribution system, Phase One and Phase Two; and

WHEREAS, as a result of said grant, a number of the streets on the initial list of resurfacing as identified in Ordinance No. 2021-24 will now be affected by the Water Distribution Replacement Project, Phase One and Phase Two, and will no longer be resurfaced as planned in Ordinance No. 2021-24; and

WHEREAS, as a result of proceeding with the Water Distribution Replacement Project, Phase One and Phase Two, the scope of the original resurfacing project for calendar year 2021 has changed in that one of the streets on the original list of resurfacing, being Edinburgh Way, which is not to be affected by the Water Distribution Replacement Project, Phase One and Two, will now not only be resurfaced, but will also have its base layer replaced; and

WHEREAS, due to the unprecedented increase in the price of paving supplies and due to the modification in scope of the original replacement project, Cast & Baker are unable to complete said project as modified for the original bid price and have increased their original bid to an estimated bid of $236,000.00; and

WHEREAS, Council desires to increase its appropriation for said modified resurfacing project from $200,000.00 to $250,000.00 in order to ideally add some additional surfacing projects once the modified project on Edinburgh Way has been completed; and

WHEREAS, Council desires to proceed with said resurfacing project, as modified, originally scheduled for calendar year 2021 and now to be completed in calendar year 2022.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ST. CLAIRSVILLE, OHIO:

SECTION 1:  That Ordinance Number 2021-29, amending Ordinance Number 2021-24, is hereby amended to allow the Director of Public Services for the City of St. Clairsville to authorize work for such resurfacing not to exceed $250,000.00 for the calendar year 2021, and to be completed in calendar year 2022, as has been modified.

SECTION 2:  That the Director of Public Services is authorized to spend funds for the resurfacing of various City streets upon award of a contract.

SECTION 3:  That this Ordinance is declared to be an emergency measure necessary for the preservation of the public peace, health, welfare and safety of the residents of the City of St. Clairsville and for further reasons that delays in the resurfacing of the City streets will adversely affect the safety interests of the residents of the City of St. Clairsville and the financial interest of the City.

SECTION 4That this Ordinance shall take effect and be in force from and after the earliest period allowed by the Charter of the City of St. Clairsville, Ohio.

PASSED at a meeting of the Council of the City of St. Clairsville on this 21st day of June, 2022, by the affirmative vote of 5 members of the council.
