ORDINANCE NUMBER 2021-16

 AN ORDINANCE AUTHORIZING AND DIRECTING THE

MAYOR OF THE CITY OF ST. CLAIRSVILLE TO EXECUTE

A GENERAL WARRANTY DEED SO AS TO TRANSFER

FOUR PARCELS OF REAL ESTATE TO THE COMMUNITY

IMPROVEMENT CORPORATION OF BELMONT COUNTY,

OHIO, AND DECLARING AN EMERGENCY

WHEREAS, the City of St. Clairsville is the owner of four parcels of real property, designated as Parcel Nos. 34-60087.000, 34-60090.000, 34-60088.000, and 34-60089.000, and more fully described in the attached Exhibit A; and

WHEREAS, Council for the City of St. Clairsville has determined that the real estate described in Exhibit “A” is not required by the City for its purposes, and that the transfer of the real estate to the Cumberland Trail Fire District will promote the welfare of the people of the City, stabilize the economy, provide employment and assist in the development of commercial activities to the benefit of the people of the City, and provide additional opportunities for their gainful employment; and

WHEREAS, pursuant to Ordinance No. 2021-9, Council for the City of St. Clairsville designated the Community Improvement Corporation of Belmont County, Ohio, as the agency for the City of St. Clairsville, Ohio, for industrial, commercial, distribution and research development; and

WHEREAS, the transfer of the subject real property to the Community Improvement Corporation of Belmont County, Ohio, will facilitate the City of St. Clairsville in obtaining the best use for the subject real property by transferring the subject real property to the Cumberland Trail Fire District.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ST. CLAIRSVILLE, OHIO:

            SECTION 1:  That the Mayor of the City of St. Clairsville is directed and authorized to execute a general warranty deed whereby the City of St. Clairsville, Ohio, shall transfer the property described in the attached Exhibit A to the Community Improvement Corporation of Belmont County, Ohio, and said property is then to be transferred to the Cumberland Trail Fire District.

            SECTION 2That this Ordinance is declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare of the residents of the City of St. Clairsville such that the real property described in Exhibit A is not required for City purposes and that the transfer of the subject real property to the Cumberland Trail Fire District will promote the welfare of the people of the City, stabilize the economy, provide employment and assist in the development of commercial activities to the benefit of the people of the City, and provide additional opportunities for their gainful employment.

            SECTION 3That this Ordinance shall take effect and be in force from and after the earliest period allowed by the Charter of the City of St. Clairsville, Ohio.

PASSED at a meeting of the Council of the City of St. Clairsville on this 21st day of June, 2021, by the affirmative vote of 6 members of the council.
